Tim Andrews Helps Shape Georgia Law with Significant Court of Appeals Decision
Poole Huffman is proud to celebrate partner Tim Andrews following his successful Court of Appeals victory, which resulted in a significant Georgia appellate decision addressing when law firm partners may be held personally liable for legal malpractice claims.
Representing the plaintiff on appeal, Tim Andrews successfully argued that corporate officers and law firm partners cannot avoid personal liability simply because the underlying duty was owed by the firm rather than the individual.
As Andrews explained to Law.com:
“The court’s decision makes it clear that if a corporate officer causes or takes part in a corporate tort, the officer cannot escape liability simply because the duty that was breached was owed by the corporation and not by the officer, personally.”
The Court of Appeals agreed, holding that a law firm partner who allegedly directed conduct causing the firm’s breach of fiduciary duty could be held personally liable for those actions. The decision establishes important guidance for attorneys, law firms, and clients regarding professional responsibility and fiduciary obligations under Georgia law.
